IR35, Off-Payroll Working: What It Actually Means

The off-Payroll working rules (IR35) have applied to Public Sector bodies since 6 April 2017 under Chapter 10, Income Tax (Earnings & Pensions) Act 2003. Under the legislation, the Public Sector body, not the agency or contractor, is responsible for determining each worker's employment status for tax purposes. Once a determination is made, the fee-payer in the chain (typically the agency) must operate via PAYE / PAYE Umbrella where the worker is inside IR35. InvitISE's role: we receive the Status Determination Statement (SDS) from the end client, pass it to the worker, operate through a FCSA & SafeREC Accredited umbrella providers, and maintain full audit trails across the supply chain.
