IR35 · OFF-PAYROLL WORKING

What it actually means for Public Sector bodies

The Off-Payroll Working rules (IR35) have applied to Public Sector bodies since 6 April 2017 under Chapter 10, Income Tax (Earnings & Pensions) Act 2003. Under the legislation, the Public Sector body – not the agency or contractor – is responsible for determining each worker's employment status for tax purposes.

Once a determination is made, the fee-payer in the chain (typically the agency) must operate via PAYE or PAYE umbrella where the worker is inside IR35.

invitise's role: we receive the Status Determination Statement (SDS) from the end client, pass it to the worker, operate through FCSA and SafeRec accredited umbrella providers, and maintain full audit trails across the supply chain.
